GDPR takes a rights-based approach: it gives individuals specific rights (access, erasure, portability) and requires organisations to respect them regardless of context.
The EU AI Act takes a risk-based approach: obligations scale with the potential harm an AI system could cause. A spam filter has almost no obligations; an AI used in hiring decisions has extensive ones.
Key Difference #3: Who Bears the Obligations
Under GDPR, the primary obligation falls on the data controller β the entity that determines why and how data is processed.
Under the EU AI Act, obligations are split between:
- Providers (developers and manufacturers of AI systems)
- Deployers (businesses that use AI systems in their operations)
Most companies that do not build their own AI are deployers under the AI Act β a role with fewer obligations than providers, but still significant requirements around transparency, monitoring, and documentation.
Where They Overlap: The AI + Personal Data Intersection
The two regulations often apply simultaneously when AI systems process personal data β which is very common. Examples include:
- AI-powered CRM systems that analyse customer behaviour
- Chatbots that collect user information during conversations
- AI recruitment tools that process candidate CVs (which contain personal data)
- Facial recognition or biometric systems
In these cases, you must comply with both regulations. The EU AI Act does not replace or supersede GDPR β they run in parallel.

- AI-specific documentation (intended purpose, limitations)
- Human oversight mechanisms for high-risk AI
